What is a QDRO and what does it do?

A QDRO, or Qualified Domestic Relations Order, is a court order used to divide certain types of retirement plans - like 401(k)s or pensions - during divorce or legal separation. It allows a spouse, former spouse, child, or other dependent to receive a portion of the plan participant's retirement benefits without triggering early withdrawal penalties or violating plan rules. 

A QDRO is issued by a state court as part of a divorce, child support, or alimony proceeding. 

It applies only to ERISA-qualified plans, such as 401(k), 403(b), and pensions. It does not apply to IRAs.

A QDRO specifies the names and addresses of the plan participant and the alternate payee, the amount or percentage of the plan that will be paid to the alternate payee, and the duration and method of the payment.

Once a QDRO is in place, the alternate payee is treated as if they were the plan participant. They can roll over their share into another retirement account, and taxes are only assessed on the recipient's portion.

Terms and Condition:

1) Preparation Fee. The cost of each QDRO/DRO is $700.00, which must be paid in advance.

2) Upon receipt of the fee, and any addition required information, the draft QDRO/DRO will be prepared. Please complete the below questionnaire for each Plan you wish to receive a QDRO/DRO for.

3) The completed draft QDRO/DRO will be sent to the Plan Participant and the Alternate Payee ("Parties") along with their respective attorneys for review to ensure the draft comports with the Settlement Agreement or the Divorce Order.

4) Upon approval by the Parties and their respective attorneys, the QDRO will be sent by certified mail to the Plan Administrator for pre-approval for qualification and processing. Please note, the Federal Government and Military do not pre-approve retirement pay orders (DROs). 

5) When notice is received from the Plan Administrator that the draft QDRO/DRO has been pre-approved, the original QDRO/DRO will be sent to the Party or attorney who contracted for the services and a copy will be sent to the other Party and their attorney. A final invoice for the work performed will be included.

*Please Note: Additional information may be needed to prepare your QDRO/DRO. If additional information is required, I will reach out to the attorneys for the parties to obtain any needed information.
